PELINDUNGAN HUKUM TERHADAP DATA PRIBADI ANUMERTA

Abstract


Saat ini, seseorang yang telah meninggal dunia tidak sepenuhnya dapat meninggalkan kehidupannya, karena serpihan jejak datanya senantiasa hidup sepeninggalannya. Penggunaan tidak sah oleh orang lain, ataupun upaya mengelola data anumerta oleh ahli waris menjadi pekerjaan rumah bagi penstudi hukum yang penting untuk segera diatasi. Tulisan ini mempertanyakan alasan seseorang memiliki pelindungan untuk data pribadinya semasa hidup, namun tidak berlanjut setelah meninggal dunia. Terbatasnya pelindungan data pribadi orang yang telah meninggal akan melahirkan potensi pelanggaran martabat hingga privasi dari subjek data, sehingga diharapkan adanya perluasan pelindungan data pribadi anumerta. Konsep post-mortem privacy protection yang telah diterapkan oleh berbagai negara dalam ragam bentuk serta aturannya dapat dijadikan alternatif solusi guna meminimalisir potensi permasalahan akibat penggunaan data anumerta di kemudian hari. Terdapat beberapa tawaran konsep yang nantinya dapat dipertimbangkan untuk diadopsi dalam mengembangkan arsitektur hukum siber di Indonesia, baik dalam tingkat konstitusi, perubahan Undang-Undang Pelindungan Data Pribadi hingga perluasan konsep regulasi lainnya yang terkait seperti halnya Undang-Undang Perlindungan Konsumen.Kata kunci: Anumerta; Privasi; Data Pribadi; Hukum Siber.
